Miradouro Ceramica

This privacy policy has been created for visitors to the website https://www.miradouroceramica.com (hereinafter referred to as the “Website”), i.e. the online store Miradouro Ceramica (hereinafter referred to as the “Store”).

The controller of your personal data in connection with the use of the Store is:
Adam Tomys, conducting business activity under the name Software Development Adam Tomys, with its registered office at ul. Mieczysława Karłowicza 11/7, 40-145 Katowice, Poland, entered in the Central Register and Information on Economic Activity (CEIDG), NIP: 4980238958, REGON: 241269451.

For all matters related to the processing of personal data, you may contact us by e-mail at: contact@miradouroceramica.com.
You may also contact us in writing at the above-mentioned address.

For your convenience, this document is divided into two parts:

  • Cookies and other technologies

  • Other purposes of processing users’ personal data

If you are short on time, click on the section that interests you most.
If you have a moment, we encourage you to read the entire document.

I. COOKIES AND OTHER TECHNOLOGIES

We use cookies and other similar mechanisms to understand how users interact with our Website and for marketing purposes — including displaying our advertisements elsewhere on the Internet.

# What are cookies?

A cookie is a small text file saved by a website on your computer, phone, or other device that you use to browse the site. The cookie contains data about your use of that website.

Some cookies are essential for our Store to function and cannot be disabled.
In other cases, upon your first visit to our Website, we will ask for your consent to install cookies.
We do not use advertising or analytical cookies (or any cookies other than those necessary) without your consent.

# What types of cookies do we use?

Essential cookies

These cookies are required for the proper functioning of the website.
You cannot disable them, because without them, our site simply will not operate correctly.

In this context, we use a tool that stores your privacy preferences.
It records your consent — or lack thereof — to the activation of particular categories of cookies on our Website.

Other essential cookies on our Website ensure its correct functioning and administration, including making updates to the site and enabling tracking tools for which you have granted consent.

Statistical analysis of our Website

We use tools that collect analytical data to help us understand how users interact with our Website.
The data we receive from these tools do not identify any individual by name, but allow us to record various aspects of user activity.
We may aggregate and analyze these data statistically, then use the results to make decisions about changes in our Store and/or in our advertising and marketing communication.

A list of analytical tools used on our Website, including:
(i) who provides each tool,
(ii) what it is used for, and
(iii) what types of data are collected,
can be found in Annex No. 1 to this Policy, as well as briefly described in the cookie consent management panel.

Advertising cookies

We use advertising tools that allow us to display our ads on other websites you visit, including social media (so-called targeted advertising).
They also help us measure the effectiveness of advertising campaigns and tailor the content of messages addressed to you based on information we possess.

In our Store, we enable users to subscribe to our newsletter.
In this context, cookies are used to embed the subscription form on our Website and measure its performance.
Modern e-mail marketing systems allow us to combine analytical data from mailing campaigns with analytics from the Store.
We may use this data to optimize newsletter content sent to subscribers.

A list of advertising tools used on our Website, with explanations of:
(i) the tool’s provider and
(ii) its purpose,
can be found in Annex No. 1 to this Policy and summarized in the cookie consent panel.

Functional cookies

Some cookies on our Website are used to activate additional tools in the Store — for example:
a chat widget, product review or rating modules, “recommend to a friend” features, or a “recently viewed products” panel.

A list of functional tools used on our Website, along with their specific purpose, can be found in the cookie consent management panel.

# Social media plugins and links

We have placed links to our social media profiles on the Website: Instagram / TikTok.
If you visit our profile in one of these services, the owner of that service will receive — as is typical when a user navigates from one site to another — information that you arrived there from our Store.

Details on how these social media services process data can be found in their privacy policies:

In the Store, we use social media plugins that allow you, for example, to share a product from our Store on your profile, “like” a product on Facebook, or save an image from our Website to your Pinterest account.
The use of such plugins involves transferring cookie data to the owners of these services:

  • the provider of the service receives information that your browser has displayed our Website, even if you are not logged into that service or do not have an account there;

  • if you were logged in to one of these social media services before visiting our Store, its provider may directly associate your visit to our Website with your account.

If you do not want social networks to associate data collected during your visit to our Store with your social media profile, please log out of those services before visiting our Website.
You can also prevent social media plugins from loading on our Website entirely by adjusting your preferences in the cookie consent management panel.

# Videos

Some videos on our Website are embedded using plugins from Instagram (owned by Meta Platforms) or TikTok.
When you play such a video on our Website, Instagram or TikTok receives information from your browser about this fact — even if you do not have a profile in these services or are not logged in.
If you are logged in, the provider may directly associate video playback with your profile.

If you wish to prevent Instagram/TikTok from collecting information about your activity on our Website, you may:

  • refrain from playing the video (your consent to play a video will be treated as consent for all similar videos until you withdraw it via the cookie settings),

  • refuse consent for cookies from that service in our cookie settings panel, or

  • log out of that service.

More information on data processing by Instagram/TikTok can be found [here / here].

# Legal basis for using cookies

The legal basis for the Store’s use of essential cookies (as described above in the “What types of cookies do we use?” section) is Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).

The legal basis for using any other cookies is your consent.

With regard to the processing of your personal data through cookies, you have the rights described below.

Our use of cookies — particularly for advertising purposes — may involve profiling.
This means that we or our marketing partners may create a user profile based on collected information (e.g. e-mail address, order history, device type, technology used, frequency of visits) and, based on this, make predictions about future purchase behavior.
This helps us decide what content (including ads) to display on our Website and elsewhere online.

# How long do cookies remain on the user’s device?

This depends on whether they are “persistent” or “session” cookies.
Session cookies (needed for browser functionalities to work correctly) expire when you close our Website.
Persistent cookies — which make your experience easier (e.g. remember screen resolution, layout, preferences, recently viewed products) — remain stored in your browser until their expiration date or until you delete them manually in your browser settings.

Third-party cookies (analytical, advertising, or social media-related) are subject to their own privacy policies, to which we provide links in this document.

II.OTHER PURPOSES OF PROCESSING USERS’ PERSONAL DATA

# How long do we process your data?

We process your data related to placing an order in the Store for as long as necessary to fulfill the order and as required by accounting and tax regulations.

In addition, we will process data for the period necessary to achieve the purposes listed in the table above (i.e. until our legitimate interest justifying the processing ceases, or until you object to the processing, or until you withdraw your marketing consent — if given).

Further processing will only occur if we are legally obliged to retain the data (especially for tax purposes) or for archival purposes to protect ourselves against potential claims (until such claims become time-barred).

# Who do we share your data with?

In our operations, we use services provided by other cooperating companies. Therefore, your data may be shared with:

  • the company providing the software that powers the Store,

  • our accounting service provider,

  • the hosting provider of our e-mail services,

  • other companies whose marketing tools and services we use.

Your data are also shared with courier companies and, where applicable, payment intermediaries to fulfill your order.
These companies act as independent controllers of your personal data.

For marketing activities described in the “Cookies” section, we use services provided by entities based in the United States (Google, Facebook).
As a result, personal data may be transferred to third countries outside the European Union.
An adequate level of data protection is ensured under the EU–U.S. Data Privacy Framework, which you can read more about [here].

# Your rights regarding data processing

We are committed to respecting the confidentiality of your personal data and to ensuring that you can exercise your rights freely.
You can exercise your rights at no cost by sending us an e-mail or contacting us otherwise.

In connection with the processing of your personal data, you have the right to:

  • withdraw your consent to data processing (if previously granted);

  • object to the processing of your data where it is based on our legitimate interest;

  • restrict the processing of your data;

  • lodge a complaint with the President of the Personal Data Protection Office (UODO) if you believe your data are being processed unlawfully.

If you have subscribed to our newsletter, we will send you marketing information about our products and/or services — e.g., new arrivals, promotions, or special offers.

You may unsubscribe at any time by clicking the link included in every newsletter or by contacting us directly.

Our e-mail marketing system allows us to analyze recipient engagement, i.e. whether a given message was opened.
We analyze such data to better tailor the content of newsletters to your interests and send personalized messages (profiling).
You may object to such processing of your data at any time.
If a subscriber remains inactive for 1 year, we may stop sending newsletters and remove them from our subscription list (after prior notice).

Your data are not used for any automated decision-making that could affect your legal situation or have similarly significant consequences.

Further legal information on newsletter rules can be found in the Newsletter Terms and Conditions (part of our Store’s Terms and Conditions).

ANNEX NO. 1 TO THE PRIVACY POLICY OF THE STORE MIRADOURO CERAMICA

LIST OF ANALYTICAL AND ADVERTISING TOOLS USING COOKIES

ANALYTICAL COOKIES

We use Google Analytics.

The information collected by Google Analytics about users includes, for example:
how many times a user visits the website; which subpages they visit; the date of the first and last visit; duration of the visit; the site from which the user accessed the website (referral source); the browser used; the clicked links; the user’s geographical location; and an anonymized (shortened) IP address, etc.

Google assigns each user its own identifier (so-called Google ID) and stores the data collected from cookies across various websites on its servers.
As the owner of the Website, we receive only reports (statistics) related to traffic on our Website.
These reports include only aggregated data concerning visitors who have consented on our Website to tracking by Google Analytics.

More detailed information about how Google Analytics works can be found [here] and [here].

You can also permanently prevent Google Analytics from recording information from your browser by installing a special plugin available [here].

COOKIES FROM THE STORE SOFTWARE PROVIDER

The provider of the software that powers our Store — the owner of the Shoper.pl platform — places cookies on our Website to collect aggregate information about how customers use online stores (visited subpages, time spent on them, viewed products, clicks on the Store’s pages, analytical information about purchases such as conversion rates).

This data is used to create aggregated reports for online store owners containing general (non-personal) information, e.g.:
which products attract customers’ interest, in which periods of the year traffic or sales increase, etc.
This allows sellers (including us) to improve their stores and optimize sales processes.

You can read the full information on this in the Cookie Policy for Visitors to Shoper Stores.

ADVERTISING COOKIES

We use Google Ads and other Google advertising tools.

Google collects data on its servers from cookies placed on your device.
These data are collected from all websites where you have consented to the use of advertising cookies by Google (including our Website) and from ads you have clicked on.
Google uses this information to display ads on other websites you visit.
Google cookies usually expire after 3 months.

As advertisers using Google’s services, we do not have access to the data stored in cookies on your device.
However, we can target ads to audiences with specific characteristics — for example, all people who visited our website (or a specific subpage) within the last 7 days.
These data serve only as statistical material for us, and ads are targeted based on aggregated criteria (specific audience groups, not individual users).

We may also use (within the Google Marketing Platform) tools that measure the effectiveness of advertising campaigns (e.g., how many people clicked on a given ad during a certain period).

You can read more about how Google uses cookies for advertising and how to manage your ad preferences [here] and [here].

Meta Conversion Pixel (Facebook and Instagram)

We use the Meta conversion pixel (remarketing pixel) for managing ads on Facebook and Instagram.

If you consent to the use of this cookie on our Website, Meta Platforms services will receive information that you visited our Website.
This information is linked to your profile in that service (if you have one).
If you are not a user of these services, the information will be associated with a so-called Facebook ID created for you.

This allows us to display ads on Facebook and Instagram to people who have already visited our Website or certain subpages (remarketing).
We then receive only statistical data from Meta Platforms about ad effectiveness (e.g., how many people saw our ad, how many clicked it), without reference to specific users.

If you have an account on Facebook or Instagram, we encourage you to read more about data protection in these services [here] and [here].

More information about the Meta remarketing pixel can be found [here].

E-mail marketing

For newsletter purposes, we use a tool provided by an external company.

The e-mail marketing system places cookies on our Website to display subscription forms and measure their effectiveness (conversion rates)
